Please carefully read these terms and conditions before registering for a FilePulse Uploader account. Registering for an account on this site (http://www.filepulse.net) indicates that you accept these terms and conditions. If you do not accept these terms and conditions, please do not register for a FilePulse Uploader account. FilePulse reserves the right to modify the Terms of Service (TOS) page at any time, and without prior notice to its users.
Prohibited Files
FilePulse reserves the right to remove or replace any uploaded files (images, videos, audio, or documents) without warning which falls under the following categories:
* Pornography, nudity, or sexual explicit content which involves any persons under or above the age of 18.
* Files that depict death, abuse, murder, rape, or torture.
* Files that promotes racism, bigotry, or discrimination towards a certain gender, sex, nationality, or race.
* Files that depict people engaging in activities illegal under United States law.
* Files that infringe on the copyrights of any entity.
* Files that are not of the allowed filetypes.
Anyone who uses this site (http://www.filepulse.net) to upload or transmit child pornography will have his or her account permanently deleted and the authorities will be contacted. All applicable logs and evidence regarding such uploads will be handed over to law enforcement agencies.
Prohibited Countries
Due to abuse, people from the following countries may not register for an account at FilePulse Uploader: Thailand.
Member Responsibilities
Users of this site (http://www.filepulse.net) will at all times follow the policies outlined in this document. In addition, users are responsible for maintaining the integrity of their accounts by using a strong password, as well as taking other security precautions. Everyone with an account on this site agrees to take responsibility for any and all usage associated with their account, and understands that it is neither the responsibility nor the obligation of the site operators to assist in recovering from security breaches to accounts. Any lost data or services, including paid services, is the responsibility of the customer.
Indemnification
In agreeing to this Agreement, you agree to indemnify, defend and hold harmless the operators of this site, their officers, directors, partners, representatives and affiliates, for any violation by you or your affiliates of this agreement that results either in (a) any cost, expense, damage or loss to the operators of this site, or (b) the bringing of any claim against the operators of this site (http://www.filepulse.net) by any third-party, and all costs, expenses, damages, and losses associated therewith.
Quality of Service
FilePulse is under no obligation to provide any Quality of Service (QoS) guarantees or adhere to any Service Level Agreement (SLA). By using this site and its services, you acknowledge the unreliable nature of the Internet, and accept that downtime and losses of data can occur. While the operators of this site try to ensure the highest quality of service to users, by providing such services, the operators of this site accept no responsibility for any downtime, loss of data, or loss of business due to the temporary unavailability or permanent closure of this website. The operators of this site, at their discretion, may work with customers to improve the quality of this site and its services, or to recover data in the event of data loss, although they have no obligation to do so.
If a user goes over his or her bandwidth limit, we have the right to stop serving their files. Users must wait until their bandwidth is reset or they are free to purchase additional data transfer.
Acceptable Use
You agree to not use FilePulse Uploader service to:
- harm minors in any way, which includes any form of child pornography.
- upload and transmit pornographic material.
- knowingly infringe on the copyrights of any entity.
- compromise the security of this site.
- compromise the security of any other website, machine, or service on the Internet.
- transmit computer viruses, trojans, worms, or any other damaging programs or software.
- promote racism, bigotry, or discrimination towards a certain gender, sex, nationality, or race.
- promote hacking/cracking activities.
- transmit spam or any other form of unsolicited advertising.
- flood websites or web forums with offensive or disturbing content.
- engage in any activities illegal under United States law.
Disclaimer of Responsibility
FilePulse reguarly monitors each account for possible violations of this agreement, howerver, we are under no duty to look at each customer's or user's activities to determine if a violation of the AUPs has occurred, nor do we assume any responsibility through our AUPs to monitor or police Internet-related activities. FilePulse hereby disclaim any responsibility for any such inappropriate use and any liability to any person or party for any other person's or party's violation of this policy.
Cancellation
FilePulse reserves the right to cancel service at any time, whether it be free or otherwise paid for, for any reason. However, in most cases, the account holder will be notified with a warning and if inappropriate activity is detected, the user account in question may be deactivated until an investigation has been completed. Prior notification to the account holder is not assured. In extreme cases, law enforcement will be contacting regarding possible illegal activity. All fees paid in advance of cancellation are non-refundable. If your account is canceled due to violation of our terms of service, FilePulse reserves to the right to ban your IP address from accessing this site.
Refunds
All payments or donations made to FilePulse are non-refundable. However, if you are disatified with our service, please contact us and we will try and work something out. Refunds may be issued at the discretion of the operators of this site.
